New Texas Law Requires More Flood Disclosure
Starting September 1, homeowners selling properties in Texas will be required to disclose whether the home is located in a 500-year floodplain, near a reservoir, whether it has flooded before or could flood in a catastrophic event. Previously, sellers in Texas were only required to disclose whether their home lies in a 100-year floodplain.
The new law comes after thousands of Houston-area properties unexpectedly flooded when Hurricane Harvey hit Texas August 2017. Many of the structures were outside of 100-year floodplains and many people did not know their homes were within the boundaries of two reservoirs. Observers say the biggest impact the law will likely have is to spur more people to buy flood insurance policies.
